Please read these Terms and Conditions (“Terms”) carefully before using the Creators Ville platform. These Terms govern your access to and use of our website, mobile application, content, tools, features, and any other services we provide (collectively, the “Service”).

By using the Service, you agree to be legally bound by these Terms and our Privacy Policy, incorporated by reference. These Terms form a legally binding agreement between you and Creators Ville Private Limited (“Creators Ville,” “we,” “us,” or “our”). If you do not agree, you must not use Creators Ville.

1. Your Acceptance

By accessing or using Creators Ville — browsing the website, downloading the app, registering an account, engaging with AI tools, or entering brand–creator collaborations — you acknowledge that you have read, understood, and agreed to these Terms. Creators Ville reserves the right to modify these Terms at its discretion; changes will be communicated via platform announcements, email, or push notifications, and continued use after modification constitutes acceptance. If you disagree, your sole remedy is to discontinue use.

2. Eligibility

You must be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher.
If under 18, you may use the Service only under the active supervision of a parent or legal guardian who accepts responsibility for your conduct.
Creators Ville serves two user categories: Creators and Brands/Businesses.

By registering, you represent that you meet eligibility requirements and are legally authorized to enter binding contracts. Creators Ville may verify eligibility at any stage and suspend or terminate non-compliant accounts.

3. Account Registration

By creating an account, you agree to:

Provide accurate information — complete, truthful, and current details.
Maintain updated records — promptly correct outdated information.
Safeguard credentials — never share your login.
Notify breaches — inform us immediately of suspected unauthorized access.

You are responsible for all activity under your account. Creators Ville is not liable for losses arising from your failure to secure your credentials.

3 A. Third-Party Sign-In

Creators Ville allows you to register or log in using Google, Meta (Facebook), or Apple. By doing so:

You authorize the applicable provider to share the account information described in our Privacy Policy with Creators Ville.
You represent that you are the authorized owner of that third-party account and that using it to register does not violate that provider’s own terms of service.
Your relationship with Google, Meta, or Apple remains governed by their own terms — Creators Ville is not responsible for the availability or security of their sign-in services.
You may revoke third-party sign-in access at any time via Settings on Creators Ville, or directly through that provider’s account settings. Revoking access may require you to set up an alternative login method to continue using your account.

4. Changes to Terms

We may amend these Terms at any time; updates are effective immediately upon posting. Significant changes may be communicated via email, in-app notification, or announcement. Continued use after changes constitutes acceptance. If you disagree, stop using the Service.

5. Services Offered

AI-driven analysis of creator profiles for brand matching.
Campaign management tools for collaboration, negotiation, and content delivery.
Analytics dashboards for performance and engagement insights.
Secure communication tools (chat, messaging, digital contracts).
Payment infrastructure for financial transactions.
Learning and community resources.

Services are provided “as-is” and “as-available.” We do not guarantee uninterrupted, error-free service or specific outcomes.

6. User Conduct

You agree not to:

Violate applicable laws or regulations.
Post unlawful, defamatory, obscene, abusive, discriminatory, or misleading content.
Impersonate another individual, creator, or brand.
Access another user’s account or our systems without authorization.
Use bots, scripts, or automated tools to exploit platform features.
Upload malicious code (viruses, malware, spyware).
Exploit vulnerabilities, referral programs, or AI-matching tools unfairly.
Disrupt normal platform operations.

Violations may result in warnings, suspension, termination, or legal action.

7. Intellectual Property Rights

Platform Content: The Creators Ville name, logos, graphics, designs, AI algorithms, software, and analytics tools are our exclusive property (or that of our licensors). No reproduction, modification, or commercial exploitation without prior written consent.
User Content: You retain ownership of content you upload, but grant Creators Ville a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute it for platform operation, marketing, or promotion.
Third-Party Rights: You warrant that your content does not infringe any third party’s copyrights, trademarks, or privacy rights.

8. Collaboration Terms (Brands & creators)

Creators Ville is solely a facilitator and is not a party to agreements between users.

Brands must provide clear briefs, timelines, and agreed compensation, and are solely responsible for honoring financial commitments.
creators must deliver authentic, original content aligned with agreed terms, deadlines, and applicable advertising regulations.
No Guarantee: We do not guarantee campaign success, exposure, or timely payment.
Contracts: Users are encouraged to formalize collaborations in writing.
Disputes: We may offer mediation but are under no obligation to resolve disputes between users.

9. Payments, Fees & Earnings

Brands may be required to pay collaboration fees, subscriptions, or premium tool fees per the pricing displayed on the platform.
creator’s earnings are processed via our payment systems, subject to service fees, transaction charges, or commissions deducted before payout.
Payment Conditions: Payments are subject to verification and fraud checks; we may delay, withhold, or cancel payments if fraud is suspected.
Taxes: You are solely responsible for reporting and paying applicable taxes.
Refunds: Payments for subscriptions, services, or collaborations are non-refundable unless otherwise specified.

10. Third-Party Links & Services

The Creators Ville platform may contain links to third-party websites, tools, or services, including but not limited to payment gateways, analytics tools, advertising services, and social media platforms — currently including Google, Meta, and Apple for account sign-in and authentication; PayPal, Stripe, and Google Pay for payments; and Google and Meta for analytics and advertising.

Creators Ville does not control or endorse such external resources and is not responsible for:

The accuracy, reliability, or legality of third-party content.
The availability, performance, or security of third-party services.
Any losses, damages, or disputes arising from your reliance on third-party tools or interactions.

You acknowledge that use of third-party services is at your own risk, and you are encouraged to review the terms and privacy policies of Google, Meta, Apple, and any other third party before engaging with them.

11. AI & Data Usage Disclaimer

Nature of AI Insights: Recommendations only — not guarantees of success or suitability.
Data Usage: May include publicly available social media data, engagement stats, demographics, or voluntarily provided details.
Limitations: AI recommendations may be incomplete, inaccurate, or outdated.
Liability: We are not liable for mismatches, campaign failures, or reliance on AI suggestions. Independent verification is encouraged.

Data used for analysis may include publicly available information from social media, engagement statistics, demographics, or voluntarily provided details by users — including data obtained through connected Google, Meta, and Apple accounts, subject to the scopes and safeguards described in our Privacy Policy.

12. Suspension & Termination

We may suspend, restrict, or terminate your account if you breach these Terms or law, engage in fraud/abuse/harassment, fail to make required payments, or misuse platform tools.

Effects of Termination: Loss of access to your account and stored data; pending payments may be withheld if fraud is suspected; we may retain certain data to comply with legal obligations or resolve disputes. Termination does not limit our right to pursue legal remedies.

13. Limitation of Liability

To the maximum extent permitted by law, Creators Ville is not liable for direct, indirect, incidental, or consequential damages resulting from loss of profits/business opportunities, data breaches or unauthorized access, platform downtime, disputes between brands and creators, inaccurate AI recommendations, or misuse of content/campaigns. Use of the Service is at your own risk. Some jurisdictions do not permit these limitations, in which case they apply only to the extent permitted.

14. Disclaimers

The Service is provided “as-is” and “as-available,” with no warranty that it will be uninterrupted or error-free, that AI recommendations will be accurate or suitable, that campaigns will achieve expected outcomes, or that collaborations will be free of disputes. Creators Ville acts solely as a facilitator and is not responsible for the conduct of creators or brands.

15. Indemnity

You agree to indemnify, defend, and hold harmless Creators Ville Private Limited, its directors, officers, employees, affiliates, licensors, and business partners from claims, liabilities, damages, or costs (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, disputes with other users, or content you upload — including claims of IP infringement or defamation. This obligation survives termination of your account.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from these Terms or your use of the platform falls under the exclusive jurisdiction of the courts of [Bengaluru, Karnataka].

By using Creators Ville, you consent to this jurisdiction and waive objections based on inconvenience or lack of jurisdiction. Users accessing from outside India do so at their own risk and remain subject to Indian law for any dispute.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force. The unenforceable provision will be interpreted, where possible, to reflect the original intent of the parties.

18. Entire Agreement

These Terms, together with our Privacy Policy and any community guidelines or additional policies, constitute the entire agreement between you and Creators Ville. This supersedes all prior discussions or understandings on the same subject matter. Updates will be published on the platform, and continued use after changes constitutes acceptance.

19. Contact Us

We aim to respond within a reasonable timeframe; general queries are typically addressed within a few business days, while legal or dispute-related matters may take longer. Communications through unofficial channels may not be acknowledged for legal purposes.
